Whether New Brand Design, Inc. is liable for the damages caused by Dualplex Laptop? Rule. In order to prove “Negligence,” a plaintiff must prove the following elements: duty, breach, cause, and damages. The plaintiff will have a case of “Strict Product Liability” if it can be proven that the seller, distributor or manufacturer of a defective product is liable to a person injured by that product regardless of whether the defendant did everything possible to make sure the defect never happened (Pease, 2019). Analysis. Given what is happening with the Dualplex 360, list the types of claims that the US customers could file in court against NBD and the arguments they might make for each element of their claims.
