You started supplying him on regular bases upon demand and didn’t notify him that you will stop supply otherwise he would not have invested heavily into the advertising for the Scuppernong products. As stated by PeckinPaugh (1998), implied contract is as simple as one party agrees to provide goods or services to the other, who also agrees to make payment at an established price.
