CRIMINAL JUSTICE2AbstractScenario:I am a detective called to the scene of a homicide in an apartment building. The deceased is ayoung male who has been stabbed numerous times. The roommate of the deceased man ispresent in the room, his shirt is covered with blood, and there is a knife on the floor. Uniformedofficers are guarding the doors and the roommate. There are four important actions I must take; Imust also know how the actions should be taken, the importance, and the consequences of nottaking the actions.Keywords: Criminal investigation, homicide, important action
CRIMINAL JUSTICE3Criminal Crime of Probable CauseAs a detective investigator, the first and legally required action that has to be taken uponarrival at the scene of the crime is to established that by all the facts and circumstances given andseen this is considered to be a probable cause which is that a crime has been committed. I beginwith examining the elements of the crime. Failure to determine the corpus delicti (body of thecrime) of the suspected criminal activity would prevent me as a detective from undertaking anyfurther investigation, and no further investigation resources could be expended on the matter.Note that “the corpus delicti cannot be proved by statements made before or after the crime butcan be proved by statements made during the crime” People vs, Carpenter, 1997). The factualelements demonstrate and supports any circumstances surrounding the crime itself and anyphysical evidence that is found in the investigation process. In this case a knife would be theevidence which may have been the weapon used to kill the deceased young man.
