BSBWHS402: Assist with compliance with WHS laws these instructions/rules, this must ensure the health and safety of the workers thus sustain their productivity at the same time. Activity 2. Using your knowledge of the relationship between health and safety Acts, regulations, codes of practice, standards and guidance material, what would you say to someone who said; (Discuss each in 50 to 80 words): 1. “Observing standards is not a legal requirement.” Based on the WHS framework, only the acts and regulations are mandatory to be complied with the law for they are legislated by the government. But by putting the standards into the practice of the workplace, this will make the acts and regulations given, to be admissible proof making the standards effectively mandatory for the legal acts and regulations to be observed. 2. “We have to do exactly what a code of practice suggests we should do.” The code only suggests what the workers have to do in the workplace, this is only a guideline whereas it will help maintaining the health and safety of the workers in their respective workplace. Although the code does not require to be complied with the law, the acts and regulations which must be following the jurisdiction, should always be observed during the undertakings. By this said, the code plays an essential role on observing the acts and regulations.
