Felony – Serious crime punishable by imprisonment in excess of one year or by death. 3. Misdemeanor – Criminal offense punishable by a fine or by imprisonment of less than one year. 4. actus reus – Element of physical conduct necessary for someone to commit a criminal act. 5. mens rea – Mental state required on the part of the accused as an element to convict him or her of criminal conduct. 6. Contract – A legally binding agreement that obligates two or more parties to do something they were not already obligated to do or refrain from doing something to which they were legally entitled. 7. Contractual agreement – A promise or set of promises for the breach of which the law provides a remedy and the performance of which the law recognizes a duty. 8. Contractual capacity – The ability to enter into and be bound by a legal contract; the ability is not diminished by age of minority or adjudicated incompetence.
