Oversight in Rulemaking In review prior weeks, we discuss the bureaucratic process and how policies are modified for agencies – an important element that has not been applied to the process are checks and balances (Harrington, 2015). We discussed and studied branches of law as well as rulemaking but not oversight. A crucial component is how each branch is responsible for ensuring the principle of democracy is present included in rulemaking. This means that those checks and balances are in place. Each independent branch has the ability and authority to inspect another branch’s enactment(s) with respect to legislation as a committee. But how does this affect rulemaking? In one of our discussions, we examined how agencies utilize processes to modify laws that pertain to their specific agency. As aforementioned, the Administrative Procedure Act (or APA) and Congressional Review Act (or CRA) govern current agency amendments, registration of said proposal, and public notification and comment(s) contributory for final review (Coglianese, Kilmartin & Mendelson, 2009).
