Blue book citation is Gonzalez v Racih (2005) (1). 545 U.S. 1 16-17 Case Summary In 1996 California voters passed the Compassionate Use Act, legalizing marijuana for medicinal purposes; despite the fact that this ratification conflicted with the federal Controlled Substances Act (CSA). The U.S. Controlled Substance Act banned possession of marijuana. Medicinal marijuana users argued the Controlled Substances Act [which Congress passed using its constitutional power to regulate interstate commerce] exceeded Congress' commerce clause power (Oyez, 2019). The Ninth Circuit Court of Appeals reversed district court ruling. Holding & Public Policy The Ninth Circuit Court of Appeals ruled the CSA unconstitutional as it applied to intrastate (within a state) medical marijuana use. Relying on two U.S. Supreme Court decisions that narrowed Congress' commerce clause power, U.S. v. Lopez (1995) and U.S. v.
