Kitty Carey Business Writing Report Rough Draft Due October 10, 2007 Medical Malpractice Cap The health care industry in America has many flaws and areas for improvement, but many believe that it is a system far superior to others throughout the world. The level of care and treatment in America is higher due to technological and scientific advances and the many talented professionals performing in the field. These benefits do not come without a price, however. Patients are capable of suing any doctor or health care firm for negligence and damages which often results in exuberant monetary awards. The financial awards that result in these suits are sometimes disproportionate to the malpractice, and the volume and frequency of such settlements jeopardize the stability of the health care system. Insurance rates for doctors and their practices have inflated, in part due to lack of limitations in these lawsuits. Some say this has forced many doctors to give up their practice altogether simply due to high insurance prices. In result of these opinions, some states have placed a cap, or a limit, on the amount of money that can be awarded in these suits. But the opposing opinion always reveals itself when laws are implemented, and some believe there are too many unique circumstances to place such a limit. Others also add that the amounts paid in these awards do not significantly affect the premiums, and should not be treated as a cause. Research seems to be manipulated into pointing both directions, so I tried to take a closer look at each angle. In Texas in 2003, legislators seemed to have conquered the issue of losing
