Running Head: CLAIMS OF NEGLIGENCE 2 Claims of Negligence The plaintiff, a 46-year-old man whom presented to the emergency room after suffering a head on collusion that resulted in an untimely man’s death. The plaintiff, on behalf of his estate has claimed negligence in the untimely death of Mr. Wyatt. The defendant, Dr. Grey has taken to the stand to describe the unfortunate circumstances that lead to Mr. Wyatt’s death. Dr. Grey recalls Mr. Wyatt coming into the emergency room for a significant amount of pain, at that point Dr. Grey administered 15mg of morphine intravenously with good effect. The patient had failed to report that he had already been using drugs and alcohol prior to the crash, as he did not want to be held responsible for the automobile incident. The plaintiff argues that the doctor did not perform a urinalysis drug tox screen before administering the morphine and the patient had suffered an overdose that lead to an untimely death.
