The moral issue, in this case, is whether it is morally right or wrong for the judicial system to rule on whether a parent has the right to smoke around their child or not. The father was very obviously concerned aboiut the health of his child while in the presence of his mother, hence it being brought up during the custody case. Over the years, there have been numerous studies done on the effects of secondhand smoke in adults, as well as children.
