Protective Order | Santasha Milner Orders of protection are very similar from one state to the next. Georgia has different protective orders to help individuals remain safe. The Family Violence Act of Georgia listed under the of Georgia’s law Family Violence is the act of any felony, any form of battery, any form of assault, criminal damages to someone’s property, stalking, the use of unlawful restraint or even criminal trespass that occurs between a spouse, parents and children, foster parents or even step-parents of children living or even formerly living in the same household. This does not include the use of reasonable discipline that is being administered properly by a parent to include the use of corporal punishment, the restraint of the child or even the detention of a child or any other family member. (“FAQ-Family Violence”, n.d.). Persons covered under the protective order The individual who is making a request to file a petition of family violence, may be eligible to file the petition in court to request a protective order. A responsible party may also ask for a petition seeking a protective order on behalf of the minor child or children. This petitioner must be a witness of the alleged occurrences of family violence.
