Nana Busia HSM 470 Professor MacGregor March 5th 2019 Case Review Paper The case I chose was the O’Neil vs. Montefiore Hospital. I chose this case because it stood out to me on how bad they treated the patient, which ended up dying after they refused to take him in. Around 5 am, O'Neil and his wife walked to the hospital worried that O'Neil was having a heart attack because of his symptoms. The nurse refused to begin treatment and told him to go home and come back later in the morning because there was no doctor covered by his insurance, which was HIP (Hospital Insurance Plan). The nurse then got hold of one of the physicians, Dr. Graig, and he also told O'Neil to leave and Dr. Kirstein will be available at 8 am to treat him. After walking back home, O'Neil then dies. One element of negligence performed was Duty of Care. There are 2 people that are in question as it relates to having a duty to provide care. Which are the nurse who seen the O’Neil couple at the hospital and the other person would be the doctor who spoke on the phone with Mr. O’Neil. The outcome of
