Surrogacy is another form of assisted reproduction in which an agreement that another woman will become pregnant and give birth to a baby for a couple who can’t conceive on their own. There are two types of surrogacy; traditional in which a woman is impregnated with the sperm of a married man and she carries the baby for the married man and his wife and gestational where the sperm of the married man is united with the egg of his wife and then implanted into another woman. In Indiana, a Putnam County court found that the surrogate mother was to be the legal parent of a child conceived from another woman’s eggs. An Indiana couple had made arrangements with the company Surrogate Mothers Inc. to hire a surrogate using the man’s sperm and an anonymous donor. A petition was filed by the surrogate, her husband and the biological father with Putnam County court to ensure the couple would have rights to the child and establish paternity and disestablish maternity.
