Microeconomics – Class Notes – 4/20/09 Clayton Act Section 2 - Price discrimination – charging different prices for different people for the same good Tries to make price discrimination illegal when you are selling the exact same thing to different people a o If you are selling slightly different things to different people – NOT price discrimination o It’s illegal when it destroys competition Section 3 – Prevents Exclusive Dealing Contract You cannot forbid the retailer from selling your competitor’s product I will allow you to sell my product Section 6 – Allows for Unions The labor of a human being is not a commodity or article of commerce Allows Agricultural cartels to operate Exempts baseball Section 7 – Forbids certain companies from Merging with each Other Closing a loophole – If two companies were prevented from merging, then the one company shuts down and sells all assets to the other company gets around the Sherman antitrust laws
