BUS 311 Week 2 Discussion 1 & 2Discussion 1: Elements of a ContractTerms of the contract between Campbell and the WentzesThe terms of the contract which existed between the Wentzes and the Campbell was forWentzes to deliver the red carrots which had been grown in the farm in the season of 1974. Thecontract was agreed to be $30 per tone with the Campbell Soup prohibiting the sellers fromselling them to anybody else unless the carrots have been rejected. Liquidated damages were alsoprovided for $50 per tone in case the seller breach any conditions of the contract. Campbell aswell gave themselves the right to dictate who will buy the rejected carrots.Wentzes performance under the contractWhen the carrots were ripe in the farm, Wentzes harvested 100 tones when the marketprice was $90. They, therefore, disliked the $30 contract and sold 62 tones to another farmer andsold some to Campbell. This shows that Wentzes did not perform under the contract.
