Nursing basics: legality, definitions, and precautions for safe practice Legal responsibilities of a nursing student o Responsible and accountable for providing safe client care to the level which you are trained. First responsibility is to PROTECT the client o Be humble…you will never know it all! Ask questions, ask for help, follow policies o Explain and ask permission… for everything…. o Allow time for the client to give informed consent! (voluntarily, capacity to understand, enough information was given to make a decision) Role of the student nurse while working as a paid employee in a health care agency o If working as a paid healthcare employee (tech, aide) follow your job description NOT your role as a student nurse! Student nurses who are chemically dependent o If you need chemicals to function you will not be allowed to practice. o SAFETY first! Protect your client from harm! What is informed consent? o informed consent - voluntarily, capacity to understand, enough information was given to make a decision Be a humble nurse. o The day you know everything is the day you should stop practicing Negligence as an unintentional tort o Negligence – when you fail to act in a careful and competent manner and thereby harm a person or damage property Ex you don’t report skin breakdown on patients, you’re negligent, just like if you caused the skin breakdown Not moving geriatric or child patient around at least every two hours o Can be caused by not performing a task or procedure correctly

Performing a task or procedure that you are not qualified to perform Making a mistake There are both negligent (accidental) and intentional torts. o Assault – intentionally attempting or threatening to touch a person’s body without the person’s permission o Battery – the actual touching of a person’s body without the person’s consent o
