1 FHWA/FTA Environmental Impact FHWA/FTA Environmental Impact Related Procedures Related Procedures Agency Responsibilities Requirements Actions of Classes Categorical Exclusions Other Specific Requirements Federal Agency Regulations More stringent and specific than the CEQ regulations Operating procedures that the agency will follow in order to comply with NEPA and the CEQ regulations Examples provided here: – Federal Transit Administration (FTA) • 23 CFR 771 – Federal Highway Administration (FHWA) • 49 CFR 622 Environmental Impact Related Environmental Impact Related Procedures Procedures Effective November 1987 – Previous guidance published in 1980, 45 FR 71968) – Incorporated previous DOT requirements: • Procedures for considering environmental impacts (DOT Order 5610.1C) 51 Comments on draft NPRM were received 26 from state DOTs 11 from transit agencies 7 from cities and counties 2 from state historic preservation officers Agency Policy Agency Policy It is the policy of the FHWA and FTA that: – a) There be a single process for environmental requirement review – b) Decisions be in the best overall public interest: balanced consideration of safe & efficient transportation and social/environmental impacts – c) Public involvement and a systematic interdisciplinary approach be required in project development – d) Measures necessary to mitigate adverse impacts be incorporated into the action • The federal agency will help fund eligible mitigation measures – e) Costs associated with EIS preparation be eligible for federal assistance – f) No discrimination will be involved in the process Proposed Action Defined Proposed Action Defined Highway or transit projects proposed for federal funding Joint/multiple use permits (e.g. changes in access control) – Note: this does not have to involve federal funds
