Knowledge will forever govern ignorance, and a people who mean to be their own Governors, must arm themselves with the power knowledge gives. --James Madison The Freedom of Information Act ± 5 U.S.C. 552 ± enacted in 1966, amended in 1974, 1986 and 1996 FOIA ± Establishes a “right to know” presumption ± vs . prior “need to know” doctrine Privacy Act of 1974 (5 U.S.C. 522a) ± Privacy Act Allows individuals to seek access to and ensure accuracy of records about themselves ± ± Restricts disclosure of personal info by Federal Agencies ± Agencies must publish info on records maintained that contain personal info FOIA and Privacy Act ± Establish “right to request” and “response” ± Do not grant “right to examine” FOIA ± Agency must specify reason for withholding any records or partial records ± Grants rights of appeal
