Wk 2 Discussion- The Exclusionary Rule The distinction between exclusionary rule and alternative remedies is a law that makes sure no illegal obtained evidence by prosecutor or law enforcement that violates the Fourth and Fifth amendment of the Bill of Rights be used in a trial. These amendments gives protection to people from unreasonable search and seizure, and trick into self-incrimination. The exclusionary rule can also not allow information of hearsay evidence to be enter in the trial. Exceptions The independent source doctrine : If evidence is collected illegal and other legally it can be allowed in the court. The inevitable discovery rule : If evidence collected illegally, but could have been found legitimate can be used in court. The good faith exception : If law enforcement officers obtain a warrant that he or she has reason to believe its a good warrant for collecting evidence then it will be allowed in court even after finding out it was problem with the warrant.
