Section 2 – Student and Assessor Instructions Conditions This is an individual assessment task to be completed with limited research time in class to be provided. Task Overview and/or Description ASSESSMENT TASK 2 – Case Study: Investigation of Jennifer Easygoing - Law clerk Jennifer Easygoing has been employed as legal clerk at Swin & Burne Solicitors for the last 4 months. She is the daughter of the best friend of one of the partners of the firm. Jennifer was ‘asked to leave’ one of Melbourne’s top ladies private schools in the middle of year 11, due to a serious breach of the schools code of conduct and spent the last 18 months ‘finding herself’. She has no formal qualifications but as a ‘favour’ was given a ‘ground floor’ opportunity with Swin & Burne Solicitors. At a weekly partner meeting of Swin & Burne Solicitors the key agenda item is a series of ‘please explain’ referral complaints received from the ACCC, Equal Opportunity & Human Rights Commission (Vic), Worksafe (Vic), Legal Services Board & Commissioner (Vic). There is also a formal letter received from the legal firm of Sue Anyone & Associates, relating to potential civil litigation against Swin & Burne Solicitors. As the practice manager you have been given the priority task of investigating the underlying issues that has led to this situation. Your investigation has led you to the conclusion that the source of the problem is the conduct of one employee being Jennifer Easygoing, with the following incidents being discovered: (Jan 12): Jennifer lodged court documents signed by herself, when questioned this her response was ‘…well there was no one in the office at the time with delegation to authorise them at the time…in any case what difference does it make?...’ (Jan 22): Jennifer was assisting one of the Swin & Burne solicitors with the preparation of a commercial contract, she was instructed by the solicitor to acknowledge the client’s instructions in line with their specific requirements with 24 hours, she failed to do so stating “…so I forgot!...I had a lot on that day!…It’s no big deal!… I will do it now!” (Jan 27): Jennifer received a phone call from the executive assistant of a major client of Swin & Burne, requesting an urgent meeting with one of the firm’s partners, it was discovered the meeting was never organised, due to Jennifer never placing a file note in the client’s file and or confirming the receipt of the communication in writing with the client (Jan 31): Jennifer was given the task of preparing standard documentation to
