McIntyre v. Nicastro”. Having to use a metal-shearing machine as part of his job in New Jersey, Robert Nicastro was in operation of such machine when he, unfortunately, hurt his hand. Due to this incident, Nicastro brought suit to the manufacturing company, J. McIntyre Machinery whom are located in England. The lawsuit was filed in the city of New Jersey. In determining where a case can be brought, the court looks at factors such as whether the company has sufficient contacts in the said state to serve the defendant; minimum contacts refer to “committing a tort or doing business” (Kubasek et al., 2013, p. 68) in said state. In this particular case, seeing how the machine that hurt Nicastro was sold by an independent distributor helped the case get an overturned verdict. Granted, the machinery would’ve made its wat to the United States eventually, but did J. McIntyre intend to purposely harm or make business in New Jersey? Absolutely not. The court did not side with Nicastro saying that the "defendant does not have a single contact with New Jersey short of the machine in question ending up in this state" (J. McIntyre Machinery, Ltd. v. Nicastro, 2011). Prior to this one incident happening, the
