WEEK 7 CASE STUDY 2 Week 7 Case Study 1: What is the difference between arbitration and litigation? What steps in the litigation process are missing in arbitration? Our book shows arbitration as a dispute resolution method where disputing parties can privately submit their disagreements to a mutual agreed upon neutral decision maker (Arbitrator) outside of the judicial setting (Pg 777). It is less expensive then litigation but if this fails litigation can follow. Once an arbitrator is chosen then the case can start immediately. Each states waiting list to be seen can be very different. Attorneys can be used to represent you in an arbitration case but it is not necessary. Arbitrators can decided what information to share and what not to share. There can be no appeals process. You pay the cost for the arbitrator and the attorney if you have one but nothing else. Litigations is a dispute resolution process going through the judicial system; a lawsuit in which a judge and jury decides the case. Litigation can take months to years and the cost can be
