Running head: 3-2 FINAL PROJECT MILESTONE ONE2Summary of CaseThe plaintiff in this case is Rosalinda Iturralde, and the defendant is Hilo Medical Center (HMC). The plaintiff is the sister of the patient, Mr. Arturo Iturralde, who passed away due to thenegligence of Dr. Robert Ricketson who worked at HMC. Mr. Arturo Iturralde went to HMC because he felt weakness in his bilateral lower extremities which resulting in him falling multipletimes. An evaluation was done, and Mr. Iturralde was sent to an orthopedic surgeon, Dr. Ricketson. During the appointment on January 24, 2001, Dr. Ricketson diagnosed Mr. Iturralde with degenerative spondylolisthesis L4-5 with stenosis. The doctor recommended that the patientbe scheduled for spinal fusion surgery on January 29, 2001. During this surgery the doctor wouldimplant two rods into the patients spine to form a bilateral fixation. In order for the surgery to be completed, Dr. Ricketson ordered the kit and it arrived on January 27, 2001. When the kit arrived, the OR staff didn’t inspect the kit for any missing or damaged materials. They instead went straight into the OR after being sterilized. Dr. Ricketson was then informed by a nurse that the kit was not inspected before. He said it was fine and proceeded to start the surgery. After
