Zero-Sum Thinking and Criminal Justice Thinking Zero-Sum Thinking in the criminal justice system would create policies that become more overarching and harsh in the context of trying not to “lose” to the opposing side, and both protecting and increasing one’s resources instead of trying to create a more just world. When President Lyndon B. Johnson labeled his efforts of curtailing crime as “The War on Crime,” he insinuated that there were sides to be on. There was his side of law enforcement and the side of lawbreakers. He was not as concerned with making a more just world for citizens; rather, President Johnson wanted to enforce the law because he needed to win a war. This brought about programs that allowed the Department of Justice increased influence over social policy, such as the Omnibus Crime Control and Safe Streets Act in 1968.
