Cornerstone of Labour Relations The collective agreement is the cornerstone of our labour relations system. It sets out the terms and conditions of employment for a specific time period. There are thousands of collective agreements, and they vary in their terms, length, and complexity, based on the industry and the employees covered.

Importance of Collective Agreement Collective agreements have significant implications for employers, employees, unions, and the public . The collective agreement will affect the employer's two core objectives identified in Chapter 4: efficiency and control over the workplace. Collective agreements impact the job security, wages and benefits of employees. A union is protected from a raid or decertification application during most of the term of the agreement. The public may be affected because prices of goods and services , and their quality and availability , could be impacted by collective agreement terms. Example: Collective agreements in education might contain restrictions on student-teacher ratios affecting the quality of education.

Collective Agreement – Legal Emphasis Collective agreement must abide by employment standards, human rights, and labour relations legislation. Mandatory Terms provision that must be included in the collective agreements because they are required by legislation. Voluntary Terms provisions that the parties agree to include in the collective agreement; however, they are not required by legislation. Mandatory Terms: Prohibition against strikes and lockouts during the term of the agreement. Provision for the arbitration of disputes relation to the administration of the agreement. A minimum term of one year. Article terms or clauses in a collective agreement.
