12B Civil Procedure Rules: Costs Capping Orders Proposals for consultation List of questions for response We would welcome responses to the following questions set out in this consultation paper. Do you agree with the definitions of ‘a costs capping order’ and ‘future costs’ (rule 44.18 (1) and (2))? If not, please give your reasons. Comments: We agree with the proposed definitions. Question 2. Do you agree with rule 44.18(3)? If not, please give your reasons. Comments: We agree with the proposed rule. Question 3. Do you agree with the criteria that have to be met for a costs capping order to be made (rule 44.18 (4))? If not, please give your reasons. Comments: We agree with the proposed factors. We note (as appears to be recognised by the criterion in sub-paragraph (c) of the draft rule) that the question of proportionality is already a factor to be taken in to account on the assessment of recoverable costs in respect of an award of costs in litigation. Therefore, the risk that a party may incur disproportionate costs will not usually, of itself, be a reason to impose a costs cap.
