Tiffany Skyler CJE 1202 Professor Paul Andrews 3. What is meant by the term “ parens patriae philosophy”? How is this manifested in modern society? Parens patriae means “parent of his or her country” in Latin. This philosophy is used by the juvenile justice system to allow the state to take control over a minor. Activists known as the child savers, thought that children should not be treated like adults in the justice system. If a child was showing signs of becoming a delinquent, they believed that someone needed to jump in and take control over that child’s well-being. This philosophy is still used in today’s society. If there is abuse of a child at home or if an adult is mentally incapable of taking care of themselves, someone is able to be appointed by the state to be their guardian. The state has the ability to immediately appoint someone that will take care of them if it is determined that it’s in their best interest to do so.
