Introduction Medical records have a vital role in ensuring quality patient care. The health care industry’s move to the electronic management of patient information is now being mandated by the federal government. Whether information is maintained on paper or in electronic form, proper management of the information requires adherence to certain legal, moral, and ethical standards.

Health Information The Health Insurance Portability and Accountability Act (HIPAA) -1996 HIPAA provides consumers with: o Protected privacy and confidentiality of health information o Standardization and efficiency HIPAA goals: o Protection of health information o Simplify claims process o Greater access to health insurance when changing jobs o Address employers’ insurance funding issues o Requiring Standard Unique Employer Identifier codes o Protect communication of health information

Health Information HIPAA vocabulary terms: Protected Health Information (PHI): personal health information. Information that can be linked to a particular individual by name, code, or number is PHI Covered Entity: anyone required to follow HIPAA’s requirements. Health care providers, insurance companies, and insurance clearinghouses are covered entities Clearinghouse: a company that receives, reviews, sends, and manages insurance claims for physicians

Health Information HIPAA’s Privacy Rule Governs and Protects sharing of patient’s confidential PHI Establishes safeguards to protect confidentiality; therefore covered entities must: o Share PHI for health purposes only o Provide minimum amount necessary o Adopt written privacy procedures o Designate a HIPAA privacy officer o Provide training to employees

Health Information The HIPAA Privacy Officer: one designated employee who oversees and coordinates all aspects of compliance Initiates internal audits to ensure ongoing compliance Coordinates external audits with Centers for Medicaid and Medicare Services Stays current with all applicable rules and regulations Keeps track of who has access to patients’ protected health information Voluntary duties should be listed in job description of appointed employee

Health Information HIPAA’s Notice of Privacy Practices Must be provided to patients at the first office visit, and whenever a copy is requested by patient Must obtain the patients’ written acknowledgement that notice has been received and file in patient record Refusal to sign should also be documented and filed in patient record Notice of Privacy Practices includes: o How the covered entity may use and disclose PHI about an individual o Individual’s rights o Physician’s office’s legal duties o Whom patients can contact for further information about the office’s privacy policies
