Miranda v. Arizona 384 U.S. 436 (1966) Facts of the Case In March 1963, Miranda was arrested and brought into the police station for questioning about a kidnapping and rape that occured ten days earlier. Miranda was never informed about his right to remain silent or his right to an attorney. After two hours of interrogation, Police obtained a written confession from Miranda of the crime that had occurred. During trial the police used this evidence against him and as a result he was found guilty for the kidnapping and rape. Issues Is the Fifth Amendment's protection of self-incrimination violated during interrogation when the person is not informed of their constitutional rights? Decisions (5-4) Yes. Reasoning The majority opinion was written by Chief Justice Warren, he stated that the interrogation violated Miranda’s fifth amendment. Since Miranda was not informed of his rights, his confession is void. The police officer was just following what always had been done and unless Miranda waived his rights, his self-incriminating confession is not admissible in a court of law.
