Catherine Lopez 5/22/19 POL320 Professor Theano Final Paper Introduction: We’ve seen an increase of human rights protection but there’s the harsh reality that not everybody gets that protection. The military ban that bars most transgender people from serving in the military is one of those serious discriminatory laws that gives a continuum of exclusion. The transgender military ban is the prohibiting of individuals who fail to register under their “biological sex”. Those already serving openly or are willing to serve under “their biological sex” would be exempted from this ban. In other words, those who seek to transition or serve openly after that happens risk discharge. This policy reversed a decision by the Obama administration in 2016. The vote was closely tied by a 5 to 4 ruling with the five Supreme Court’s conservative justices leading. The justices may have by influenced by the complaints of the lower cases and their inability to implement policies applicable to the entire country. However, the Supreme Court turned down hearing the immediate appeals from two trial court’s rulings blocking the policy. In doing this an expedited decision on this policy was prevented. Although courts had previously barred the Trump administration from enforcing the policy as a result of lawsuits filed by LGBT legal groups, The United States Supreme Court lifted the order which allowed the ban process to go smoothly. Consequently, the ban became implemented on April 12, 2019 nearly two years after Trump shot off tweets declaring the

military “will not accept or allow transgender individuals to serve in any capacity”. As described by the Pentagon, the policy discharges service members who are diagnosed with gender dysphoria or are prescribed transition-related care like hormones and surgery related to gender transition after the policy implementation. The Defense Department has insisted the new policy is a medical-based policy applied to every service member, even though the policy only applies to transgender people, and that it is not a ban, even though it blocks many transgender people from service. However, The American Medical Association or the AMA, have found no medical basis on which to ban transgender people from the armed forces. The AMA has repeatedly said that there is no medically valid reason, including a diagnosis of gender dysphoria, to exclude transgender individuals from military service. Other arguments: It’s important to understand the argument beyond the ban. Many deem the ban as a necessity. One argument for this exclusion is transgender people having a mental illness. Depression and suicide are high within the LGBTQ community. Many of those who have undergone sex-reassignment surgery and are unhappy with the result are prone to depression.
