Discussion Section Notes Week 1 What purposes does the law serve? People are going to act in pursuit of their desires in ways that will inevitably conflict with the interests of others and law provides a way to regulate behavior so that we might meaningfully pursue these ends. Key concepts we discussed in class: law operates to benefit people’s interests; trade-off between certain freedoms and personal security; enforcement of the law provides a kind of guarantee that everyone is playing by the same rules and no one is left being a sucker; social contract theory; state of nature Authority of Law: What is authority? How does one get it and how do we recognize it? How does authority create an obligation to obey? What is unique about the law, and criminal law in particular, that gives us a reason to obey? Does the law’s authority justify punishment when we fail to obey? What kinds of authority are there? Practical: tells you what to do (e.g. legislature)
