CCJ3117 Chapter 10 Study Guide: Answer Key 1. What is the definition of: a. Violent crime = the use of, or threat of force on a victim by an offender” b. Homicide = the killing of one human being by another (note: not all homicides are illegal, e.g. in war) c. Murder (general) = the intentional killing of another person, malice is involved. There are several types (i.e. first degree, second degree) d. Malice = an offender’s awareness that they didn’t have a right to kill e. First degree murder = intentional killing with malice AND premeditation f. Second degree murder = intentional killing with malice WITHOUT premeditation g. Felony murder = does not require intent to kill, but occurs alongside a felony (e.g. arson, rape, robbery) h. Manslaughter (general) = unlawful killing of another person, malice is NOT involved. Can be voluntary or involuntary. i. Voluntary manslaughter = killing committed INTENTIONALLY BUT WITHOUT MALICE. Times in which a person may not be rational (e.g. in extreme circumstances of shock, ‘in the heat of passion’).
