Abstract This short paper will go over why healthcare stakeholders disagree about the impact of legal risks, medical malpractice claims, tort reform, and defensive medicine cost of care and the cost of health insurance in the United States as well as the importance of such an impact. I will explain how all of these impact the relationship between healthcare providers and patients. I will then describe how all of these factors should impact the relationship, as well as suggesting improvements to already existing healthcare policy regarding this topic. 2

Legal risks, medical malpractice claims, tort reform, and defensive medicine impact all significantly affect the relationship between healthcare providers and patients. To start, medical malpractice is “improper, unskilled, or negligent treatment of a patient by physician, dentist, nurse, pharmacist, or other healthcare professional” (Texas A&M University, 2016). Patients involved in medical malpractice claims are often reluctant to receive care. These concerns are so substantial that patients are not trusting of their doctors or any doctor for that matter which negatively impacts the provider-patient relationship. Recent studies have shown that malpractice even affects the cost of healthcare. Currently in the United States, many Americans cannot afford healthcare services as it is.
