Amy Higel 10/21/2019 PLA 4830 1. History of Ireland’s Legal System a. Celtic tribes arrived on the island between 600 and 150 B.C. each tribe had an individual king. In the 10th century began the rule of just one king b. The Irish Free State, established under the terms of the treaty with the same constitutional status as Canada and the other dominions in the British Commonwealth, came into existence on December 6, 1922 and lasted until 1932. c. Between 1932 and 1948 the Labor party was in charge and the quest to be a sovereign nation began. In December 1936 de Valera seized on the removal of King Edward to push through two bills: the first deleted all mention of the king and the governor-general from the 1922 constitution; the second, the External Relations Act, stated that Ireland only recognizes the crown for diplomatic representation. De Valera’s new constitution came into effect on December 29, 1937 and made “Ireland”—the new name of the state. De Valera was reelected 2 more times and remained neutral during WWIII which ultimately led to them losing power at the 1948 General election. d. In 1949 John Costello introduced the Republic of Ireland Act. This act repealed the External Relations Act of 1936. The act was established on April 18, 1949. In the 1950’s power shifted several times between the parties. In 1957 Fainna Fail was returned to power and stayed that way for 16 years. The next few years were pretty stagnant in politics and growth. In 1973 Ireland Joined the European Economic Community and in May 1987 a constitutional referendum ratified the Single European Act and confirmed Ireland’s participation in the EEC. The act called for the harmonization of social and fiscal measures taken within the EEC. e. Current Prime Minister s Leo Varadkar, Irish politician who became leader of the Fine Gael party and Ireland ’s first openly gay leader took office in June 2017 2. Main Constitutional rights: equality before the law, right to life, personal liberty, freedom of expression, freedom of assembly and the right to fair procedures 3. Current Court Structure a. common law system based on the English model but substantially modified by customary law; i. The court of summary jurisdiction is the District Court. The country is divided into 23 District Court districts. There are 46 judges of the District Court including the President of the District Court.
