Sample Notice of Cancellation Pursuant to 18 C.F.R. § 35.15 a market-based rate seller must file a notice of cancellation when it wants to cancel the market-based rate tariff it has on file with the Commission. The market-based rate seller must submit through the eTariff system a filing reflecting this cancellation. This notice of cancellation must include a transmittal letter which states the reasons for the proposed cancellation and a list of the affected purchasers. The notice of cancellation filing is a substantive type of tariff revision and the seller should use filing code 420 (if the seller only has a market-based rate tariff on file and is accordingly a Program M filer) or 410 (if the seller has at least one tariff on file that is not a market-based rate tariff and is a Program E filer) when submitting their filing to be sure it cancels both the tariff record and complete tariff ID.
