AN AFFAIR, A TRIAL AND AN EXECUTION 2 An Affair, a Trial, and an Execution As justice officials, the judge and the prosecutor should have known working on the same case is a conflict of interest. The judge especially should have spoken up about the affair whether it was thought to be “long-rumored” or not. It was very immoral for the judge and the prosecutor to continue the case knowing the issue of the relationship could arise. If this affair was common knowledge like the prosecutor said, then it should have been assumed that the offender would take advantage of the situation. This exact probability is why companies have restrictive policies on relationships within the work place. How different would the situation be if the prosecution was having an affair with the offender? The same principles should be applied. It would be forbidden for the offender and prosecutor to hold a relationship as it could cause issue with the ongoing

Since the prosecutor and the judge were working the murder case together, the offender could protest all odds in the court room were working against him. It could and probably be assumed that they may have combined their legal power and built a stronger case against the offender resulting in a stricter sentence. This shows an unfair situation for the offender who could ultimately stand for a retrial possibly resulting in a lesser sentence than he deserves. The text reads, “All ethical decisions affect others…” (Albanese, page 125). It was immoral for the judge and the prosecutor to not disclose the nature of their relationship, and by not doing they caused havoc in the justice system.
