Smunt, there are many legal considerations that need to be reviewed in order to determine the likely outcome of the breach of contract suit against Mr. Lamar Smunt: Review of Findings: Mr. Smunt offers in writing to pay Mr. Roginsky $500,000 to paint a portrait Mr. Roginsky counters the original offer at $750,000 to paint the same portrait Mr. Roginsky reconsiders and accepts the original terms of $500,000 Mr. Roginsky accepts original terms prior to Mr. Smunt’s review of the counter-offer Mr. Smunt revokes the offer in its entirety Mr. Roginsky files a breach of contract suit At the onset of the case review, the foundation of the case rests on whether the offer made by Mr. Smunt was a legal offer.
