WRONGFUL CONVICTION AND EYEWITNESS TESTIMONY 2 Abstract Wrongful conviction is a subject that has been a challenge in numerous courts all over the world. At times it is caused by the recklessness of officials involved. Eyewitness misidentification is the primary factor that leads to wrongful conviction. It occurs when a witness to a crime gives false information that leads to the crimination of an innocent individual. This paper examines some of the reasons as to why eyewitness should not be taken as reliable evidence for a case. The content of the manuscript reveals that there are many people wrongly accused and penalized only to be found innocent later on. As a result of this, the death penalty has been opposed by many people since it is irredeemable. The frequent occurrence of wrongful conviction has a negative influence on citizens’ attitude toward the national justice system. In this paper, one gets to know of ways that can be applied to help improve the reliability of eyewitnesses. The research below is not biased and does not blame anyone for wrongful conviction; instead it looks at its possible causes hence elevating hopes of its elimination. The citizens and the official in the judiciary of country have a part to play in preventing innocent persons from being burdened with the fault of other criminals. Key words: Wrongful conviction. WRONGFUL CONVICTION AND EYEWITNESS TESTIMONY 3 Wrongful conviction and eyewitness testimony Wrongful conviction has become rampant in the criminal justice system and deserves to be addressed worldwide. It occurs when an alleged criminal is found guilty in the court of law yet he or she is innocent. Despite not having committed a felony some people are convicted either on the ground of planted evidence or lack of evidence to prove their innocence. There are specific punishments for a crime that humanitarians all over the world have been fighting against. For instance, the execution has been opposed by many since in the case of it being passed on an innocent person it cannot be undone. Unfortunately, many persons were killed for being wrongfully convicted. Such happenings are sad and frustration especially to the family members of the deceased. Also when a person is executed, then it is later on proven that he or she was innocent, this leads to people losing trust in the judiciary system. Citizens will, therefore, tend to not depend on the law whenever they want justice to be served. The fact of the possibility of wrongful conviction and mounting of evidence has reinforced the opposition of death as a criminal penalty. The matter of death penalty is a subject of division between conservatives and liberals. Liberals believe that some crimes are best punished by death. This group of people does not see the essence of giving someone a chance to reform. However, due to cases of wrongful conviction, the liberals have had to switch side and
