Sunday, December 1, y Intro. To Criminal Justice Discussion 3 Ch. 8 What is the difference between factual guilt and legal guilt? Should a person found to be legally not guilty be FORCED to be tried again IF that person proclaims his guilt AFTER being found not guilty? This obviously vio - lates double jeopardy but SHOULD this be changed so as to prosecute those who are factually guilty? Factual guilt is when the person is actually responsible for a crime. Deals with the is - sue of whether the defendant is responsible for the crime of which he or she is ac - cused. if the defendant did it, he or she is guilty. Legal guilt is when when evidence is presented to convince a judge and or jury that the person is guilty. Established when the prosecutor presents enough evidence to convince the judge or jury that the defendant is guilty. Defendants who committed a crime may be found not guilty. Well each case is different from the next, we see high profile cases in the media. I
