10/30 Skyler Pittman Dr.Bazinet Music and Law The New York City transit authority has a rule that expressly allows people to play music beneath the streets. State laws prohibits people from loitering in the subway “for the purpose of soliciting or engaging in business,” that law seems to contradict the MTA rule, which allows performing for money. Performing for donations, also called busking, is legal ever since it was challenged in 1970 by poet Allen Ginsburg. It is legal for a person to perform in the train stations but they have to follow a few laws. For example, “You are required to have a permit for some public performances. You must have a permit to use a sound device such as a loudspeaker, megaphone, or stereo in a street performance...The fee is $45. You do not need a permit for street performances without a sound device. The Music Under New York (MUSIC) program plan events throughout the transit system. You do not have to be part of the program to perform in the subway system, but you must follow the MTA's rules.
