Number 81 Heart of Atlanta Motel v. U.S., Katzenbach v. McClung Facts: The Civil Rights Act of 1964 forbids racial discrimination in public places, except in limited situations of private clubs and other, few examples. The Heart of Atlanta Motel did not fall under this private category, and sought an injunction against this legislation from a three- judge panel, which the motel did not get. The motel refused rent to blacks as well as advertised its business mostly coming from out of state, and thus sued. The Katenzbach case was brought to the Supreme Court as a lower court ruled in 1925 in a local restaurant case that a restaurant can discriminate against blacks since the restaurant would lose substantial business if it served blacks. The Attorney General Nicholas Katzenbach appealed this decision. Question of Law: Did Congress violate the commerce clause when it ended discrimination under the Civil Rights Act of 1964? No. Opinion (Clark in Heart of Atlanta): The Civil Rights Act, being affirmed in legislation, is designed to eliminate discrimination. This act is fundamentally different from the Civil Rights act of 1875 which was declared unconstitutional. The Court did not sustain whether the former act was sustainable under the commerce clause, nor did the former act limit the ubquity of businesses that were under jurisdiction from the act.
