CASE BRIEF 2 Citation: Pickering v. Board of Education, 391 U.S. 563 (1968) Facts: The BOE (Board of Education) fired the instructor after the writing and addressing in the newspaper about the misallocation of finances in the learning and sports programs. The teachers presented information regarding the BOE methods of misinforming the taxpayers on the reasons for adding taxes. The Board claimed that the teachers gave false statement regarding their performance. There was insufficient proof on the effects of the teacher’s remark on society and school leadership. The Illinois courts supported the Board’s claims on the instructor’s presentation on affecting the best interests of the learning institution. However, the teacher claimed that the reports were protected by the 1 st and 14 th Amendments.
