Zack Poitras PO 150-01 Case Brief #1 10/23/19 Case Name: Loving v. Virginia Case Number / Citation: 388 US 1 (1967) Facts of the Case: In June 1958, two residents of Virginia, Mildred Jeter, a black woman, and Richard Loving, a white man, were married in the District of Columbia. After their marriage, they returned to Virginia where the Circuit Court of Caroline County issued an indictment charging the Lovings with violating Virginia’s ban on interracial marriages. On January 6 1959, both Mlidred and Richard pleaded guilty to the charge. The Lovings were sentenced to 1 year in jail, although the judge suspended the sentence if the Lovings left Virginia for 25 years and not return. In November 1963, the Lovings filed a motion with the Virginia State Trial Court to set aside the sentence claiming the statutes which the Lovings had violated were in conflict with the 14th Amendment. Without a decision being made by October 28 1964, the Lovings filed a class action lawsuit in the United States District Court for the Eastern District of Virginia. With no
