2TURNIP PLAZA HOTEL ANALYSIS Turnip Plaza Hotel AnalysisIntroductionMark Piper was employed with the Turnip Plaza for several years as an experienced tour guide in Michigan. His reputation made him one of the best tourist guide around the area which brought significant revenue for the company. Mark was not only one of the best tourist guide butwas considered one of the most skillful and well known and was even featured on extreme sportstelevision. He was so well known for his reputation at being the best that guests will specificallyrequest for him to be their guide. Without a doubt, Mark’s high adventure kayaking tours brought in significant revenue for Turnip Plaza and its rivals took notice. A month ago, Stacey Nguyen, manager of Huron Overnight Inn, one of said rival companies approached Mark and made him an offer of a substantial salary increases to leave the Turnip Plaza Hotel and to go work for her Company. Even though Mark enjoys what he does at Turnip Plaza and has tenure with them, the offer being made by Ms. Nguyen on behalf of Huron Overnight Inn was an opportunity that Mark thought was worth considering and asked her to give him 48 hours to think about it. Mark was so excited at the thought of this opportunity, he mentioned the pending deal to other colleagues in his workplace. Unfortunately for Mark, before he had the opportunityto accept the deal offered by Huron Overnight Inn, one of the colleagues he had trusted with the information reported the details of the pending offer to Edward Griffin, Mark's current manager at Turnip Plaza. Mr. Griffin fully recognized that losing Mark to a rival company will leave a void in his department and could potentially cost Turnip Plaza to lose some business to one of its rivals so he immediately arranged a meeting with Mark to discuss a counter. During the meeting,Mr. Griffin made a proposal to Mark: He said “If you stay with Turnip Plaza, I promise that next
3TURNIP PLAZA HOTEL ANALYSIS month you will receive a promotion with a 50% raise and a guaranteed contract for a two-year term.” The offer being made by Mr. Griffin to Mark sounded great so he turned down the pending offer from Stacey and accepted the counter made by his current employer, Turnip Plaza. Unfortunately for Mark Turnip Plaza did not make good on their promise because he was dismissed before his new contract even started even though they were fully aware that he had only stayed with them based on the counter-offer and that he had turned down the other offer with a substantial raise made by Huron Overnight Inn.The purpose of this report is to research and determine the following:1.What legal theories Mark might use to try to legally enforce Edward’s promise2.Damages and remedies available to Mark in the event he files a successful lawsuit againstTurnip Plaza.
