OVERVIEW. This is a course in Torts, which along with Contracts and Property, is a common law building block of our legal system. We will study the questions of legal liability and compensation through the litigation process. Tort law overlaps with many central legal issues that will follow you throughout your time in law school and throughout your legal career: When do we owe a duty to someone else for the consequences of our actions? What is the nature of that duty? To what extent can legal institutions be used to compensate harms and deter undesirable conduct? What is the role of the courts in deciding these questions? What is the role of the attorney in coming up with answers to these questions? Sometimes arcane, most often stimulating, the subject of torts is never irrelevant for understanding how our legal system functions. EXPECTATIONS.
