Armendariz v. Foundation Psychcare Services, Inc. Sup Ct of Cal (2000) p. 416 J. Mosk FACTS: P’s filled out employment contract w/ arbitration agreement pertaining to any wrongful termination action. A year later they renewed the specific arbitration agreement. A year after that they were terminated. The trial ct held that the arbitration agreement was unconscionable. The ct of app held that the damages provision was unconscionable and against public policy, but the rest of the arbitration agreement should be upheld.
