Sup Ct of NJ (1966) Collester Defendant (Oakwood Park Homes) sold a home to Mr. Pendergast who ordered shrubbery from the plaintiffs (Callano) to be placed on the property. The shrubbery was placed on the property but the decedent died before payment was made to the plaintiffs. The contract of the sale of the house was cancelled due to the death of Mr. Pendergast, and Oakwood sold the house to someone else with the shrubbery on the property. Oakwood did not know that the shrubbery had not been paid for.
