RESEARCH PAPER 1Research Paper Brooklyn D. Pitsch Saint Leo University
RESEARCH PAPER 2Abstract The criminal justice system plays an important role in constructing and enforcing the laws provided by the Constitution of the United States of America. We are provided the delivery of justice to those who have committed crimes, but is justice always delivered fairly? When it comes to the criminal justice system, we would expect that everyone be given the same respect and treatment in the court of law. Discrimination of any type should not be a topic that arises when deciding the fate of one’s future. Unfortunately, in today’s society, racial discrimination to the minority of the population seems to be a repeating issue that we tend to see more and more as the days progress. We see it on the television. We hear it on the radio. We even scroll past it on social media. The question is, why is racial discrimination starting to arise again? When will this upraise settle down? Will this upraise diminish? What impact does racial discrimination have on the criminal justice system?
RESEARCH PAPER 3Criminal justice, we ask ourselves what is criminal justice? Why do we have a criminal justice system? What is a criminal justice system supposed to do for the citizens of the United States? According to the dictionary, criminal justice is the delivery of justice to those who have committed crimes. It is the system of practices and institutions of governments directed at upholding social control, deterring and mitigating crime, or sanctioning those who violate laws with criminal penalties and rehabilitation efforts. Those accused of crime have some protections against abuse of investigatory and prosecution powers. The last sentence of that definition states that “those accused of crime have some protections against abuse of investigatory and prosecution power;” but in today's society, is that necessarily true? According to the Sixth Amendment, we are all guaranteed the rights to a fair and speedy trial. The Fourteenth Amendment gives the equal protection clause as well as due process. This clause says that no state shall deny to any person within its jurisdiction the equal protection of laws. Due process is the fair treatment through the normal judicial system, especially a citizen's entitlement. The United States Criminal Justice system has numerous amendments, laws, and processes that are in place to provide equal and fair treatment to every legal citizen within its border. If this is true, why is the system so unfair when it comes to the minorities in the population of the country? There are at least three views when it comes to racism: personal prejudice, ideological racism, and institutional racism. Personal prejudice is a view or judgment that someone has for another person or group based on their real or perceived group membership. This can affect the way a
