Abraham Dweck 12/14/08 Prof. Joe Zavaglia BUSI221 Essay #1 In this case since Ben was already selling his books at $100 prior to meeting Jane at a singles bar. He should be able to demand $100 from her or the books back. Before meeting with Ben personally Jane already knew that he was selling his books and the only reason she was going to get the books for free was because he assumed that there was going to be a relationship starting between them, Therefore once he sees that she is married and that there is no relationship there then he can demand the books back or get $100 from her. Since it was implied when they met that he was interested in her and they were in a singles bar I believe that in law he would be able to prove that he was only giving it to her on the premise that a relationship would be created. Whether he would win or not is up to the judge’s philosophy of law. Essay #2 In this case, it is Mary’s duty before she tells Alice that she should make this huge commitment, to check her background.
