United States first dealt with this issue Samuel Roth was convicted of 26 counts of sending obscene materials through the mail in 1954 The court upheld the conviction but established some guidelines regarding obscenity The test is “whether to the average person, applying contemporary local standards, the dominant theme of the material taken as a whole appeals to prurient interests – It must be utterly without redeeming social importance
